Overview And Acceptance

DYERS & CO. Clothing operates this clothing store. In these Terms and Conditions, “we,” “us” and “our” mean DYERS & CO. Clothing. Shopify provides the platform that hosts our online store. By using the store or placing an order, you agree to these terms and the policies linked here, subject to applicable law. Please read our Privacy Policy, Shipping Policy and Refunds & Returns Policy.

Using Our Store

You must be of legal age to enter a purchase agreement, or have the consent of a parent or guardian where allowed by law. Provide accurate contact, billing and shipping information and keep account credentials secure. Do not use the store for unlawful activity, infringe others' rights, submit malicious code or interfere with the service.

Products And Information

We sell everyday clothing for men and women. Materials, size options and measurements are described on the relevant product page. Please review measurements before ordering; size labels may differ between styles. Colors can vary with screens and lighting. We aim for accurate information, but may correct errors in descriptions, pricing or availability. If a material error affects an order, we will contact you to agree a correction or cancel the affected order with a full refund.

Order Acceptance

Placing an order is an offer to purchase. An order confirmation acknowledges receipt and does not by itself guarantee acceptance or availability. We may decline or cancel an order for a genuine stock, payment, fraud or information issue. We will notify you and refund any payment received for items we cannot supply. Nothing in these terms removes rights you have under applicable law.

Pricing And Payment

Prices and payments are in US dollars (USD). Applicable taxes and the final order total are shown at checkout before you pay. Payment methods are those actually displayed at checkout and are subject to authorization by your payment provider. Do not submit an order unless you are authorized to use the chosen payment method. Discounts apply only under their stated conditions.

Shipping

We deliver within the United States. Standard shipping is free on all US orders. Processing takes 1–3 business days, followed by an estimated 3–5 business days in transit with UPS. The daily order cutoff is 2:00 PM Eastern Time (ET). Business days are Monday through Friday, excluding US public holidays. See our Shipping Policy for full details and tracking information.

Cancellation Returns And Refunds

Contact us before dispatch to cancel an order for a full refund without a handling fee. After dispatch, follow our returns process. Return and exchange requests must be made within 30 calendar days after delivery. We process approved return refunds within 1–3 business days after receiving the return; cancellation refunds are processed within 1–3 business days after confirming cancellation. Funds typically appear within a further 1–3 business days, but banks and payment providers may take longer. Our Refunds & Returns Policy explains eligibility and responsibility for return shipping.

Intellectual Property

Store text, branding, photographs and other content are owned by us or used with permission from their owners. You may use the website to shop and for personal, noncommercial purposes. You may not copy or commercially exploit protected content without the rights holder's permission. Third party trademarks remain the property of their respective owners.

Third Party Services And Shopify

Third party websites and services have their own terms and privacy practices. Shopify hosts the store but is not the seller of our products; purchases from this store are made with DYERS & CO. Clothing. To the extent permitted by law, Shopify and its affiliates are not responsible for claims arising from your purchases from us. We remain responsible for our obligations as the seller.

Disclaimer Of Warranties

We aim to keep the store available and accurate but cannot guarantee uninterrupted or error-free access. To the extent permitted by law, the website service is provided as available. This provision does not exclude statutory product warranties, rights relating to defective or misdescribed goods, or other protections that cannot lawfully be excluded.

Limitation Of Liability

To the fullest extent permitted by law, we and our service providers will not be liable for indirect, incidental, special or consequential loss arising from use of the website, including loss of profits or data. No provision excludes liability for fraud, willful misconduct, gross negligence, personal injury where exclusion is unlawful, or any liability that cannot legally be limited. Mandatory consumer rights continue to apply.

Termination

We may suspend or terminate access for a material breach, unlawful conduct or a security concern, subject to applicable law. Termination does not remove payment obligations already incurred, rights relating to existing orders, or accrued claims. Provisions that by their nature should survive, including intellectual property, liability, indemnification and governing law, remain effective.

Indemnification

To the extent permitted by law, you agree to indemnify DYERS & CO. Clothing, Shopify and their respective service providers against reasonable third party claims and costs arising from your unlawful use of the store, infringement of another person's rights or material breach of these terms. This does not apply to claims caused by the indemnified party's own wrongdoing. We will provide notice of a claim and reasonable cooperation; any settlement imposing a nonmonetary obligation on you requires your consent.

Governing Law And Disputes

These terms are governed by the laws of Indiana and applicable United States federal law, without removing mandatory consumer protections that apply to you. Please contact us first about an order or dispute so we can try to resolve it.

Changes And General Terms

We may update these terms by posting a revised version with a new effective date. Changes apply prospectively and do not reduce rights for an order already placed. If a provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision does not waive it. These terms and the referenced policies form the agreement for use of the store.
